1. The Two-Stage License

Indonesia licenses mining in two stages. IUP Eksplorasi covers survey and drilling within a defined block (WIUP area won via auction or application). IUP Operasi Produksi allows extraction — granted only after a feasibility study, reclamation plan and environmental approval (AMDAL/UKL-UPL depending on scale). Skipping straight to production talk without the exploration paper trail is the classic foreign-investor mistake.

2. The ESDM Path, Step by Step

One: secure the WIUP block and entity (PT PMA for foreign capital). Two: exploration work program with annual reporting to ESDM. Three: feasibility + environmental documents. Four: production license application with RKAB annual work-and-budget plan. Five: ongoing compliance — production reporting, reclamation guarantees, domestic market obligation (DMO) for coal. Each gate has document checklists; incomplete filings, not policy, cause most delays.

3. Foreign Ownership Reality

Foreigners participate through PMA companies, but mining carries divestment expectations over the license life plus practical partnership pressure at regency level. Structure ownership, offtake and financing with a mining-specialist lawyer before exploration spend — restructuring mid-project costs multiples. Kalimantan regencies vary in how they interpret central rules, so local counsel is not optional.

4. Environmental Papers Make or Break

Forested or watershed blocks trigger full AMDAL with public consultation — budget real time and community engagement, not just consultant fees. Post-mining reclamation guarantees are cash-backed. Buyers and financiers now diligence environmental files first; a clean AMDAL record is a saleable asset, a contested one is a discount.

5. Practical Entry Path

Most successful foreign entries: start with a producing or near-producing asset via JV rather than greenfield exploration — faster cash flow, known geology, existing permits to verify. Due-diligence order: license validity at ESDM, forestry status, overlapping claims, environmental standing, then commercial terms. Never pay for "guaranteed licenses" — issuance follows process, not payments to intermediaries.
